2.1 Service Scope
The Service analyzes publicly available social media data. We do not provide:
- Guaranteed content success or specific performance outcomes
- Access to private or protected social media content
- Content creation services (we provide insights and recommendations only)
- Legal, financial, or professional advice
2.2 Beta Features
Some features may be offered as "beta," "preview," or "early access" versions. These features:
- Are provided "as-is" and may contain bugs or errors
- May be modified or discontinued without notice

6. Intellectual Property Rights

The Service, including all software, algorithms, AI models, designs, text, graphics, logos, icons, images, audio, video, data compilations, and the overall "look and feel," is owned by PostPulse or our licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
All rights not expressly granted to you are reserved by PostPulse.
6.2 Limited License to Users
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

7. Payment Terms and Billing

PostPulse offers subscription-based access to the Service. Subscription plans include:
- Monthly Subscription: $29 per month

7.2 Free Trials and Waitlist Access
We may offer free trials or early access programs for new users. Free trial terms:

- Automatic Conversion: If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan
- Eligibility: Limited to one trial per user; not available to previous subscribers

7.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.

- Your payment fails or your account becomes past due
- You engage in conduct that harms or may harm PostPulse, other users, or third parties
- We are required to do so by law or court order
9. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, PostPulse disclaims all warranties, including but not limited to:

- Warranties that the Service will meet your requirements or expectations

9.1 AI-Generated Content Disclaimer
Our Service uses artificial intelligence and machine learning to analyze data and generate insights. AI-generated content may contain errors, inaccuracies, or biases.
- No Guarantee of Accuracy: AI insights are predictions and recommendations, not guarantees
- Independent Verification: You should verify AI-generated insights before relying on them
- Human Oversight: AI systems may produce unexpected or incorrect results
9.2 Results and Performance
We do not guarantee any specific results, outcomes, or performance improvements from using the Service.

10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POSTPULSE SHALL NOT BE LIABLE FOR:
Indirect, Incidental, Consequential, or Special Damages, including but not limited to:
- Lost profits, revenue, business opportunities, or savings
- Loss of data or content
- Business interruption or downtime
- Loss of goodwill or reputation
- Costs of procurement of substitute services
10.1 Cap on Liability
THE TOTAL LIABILITY OF POSTPULSE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:
- (A) The total amount you paid to PostPulse in the 12 months preceding the claim, OR
- (B) $100 USD
11. Indemnification
You agree to indemnify, defend, and hold harmless PostPulse from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
- Your use of the Service
- Your violation of these Terms or any applicable laws or regulations
- Your violation of the Acceptable Use Policy or engagement in prohibited activities
- Your infringement of intellectual property rights of PostPulse or third parties
12. Dispute Resolution and Arbitration
12.1 Informal Resolution

12.2 Binding Arbitration
